‘Can’t jail citizens just for disagreeing with government’: Court while granting bail to Disha Ravi

Delhi’s Patiala House Court on Tuesday granted bail to 21-year-old climate activist Disha Ravi, who was arrested for allegedly sharing a ‘toolkit’ on social media related to farmers’ protests. Additional Sessions Judge Dharmendra Rana granted this relief to Ravi on a personal bond of one lakh rupees and two sureties of the same amount. She is currently in police custody. During this, Disha Ravi’s mother Manjula said that we are very happy and believe in system and law.

The court said that there does not appear to be any direct link between Disha Ravi and the banned organization ‘Sikhs for Justice’. The investigating agency cannot be allowed to further restrict civil liberties on the basis of favorable forecasts. Apparently there is nothing that indicates that Disha Ravi has supported any separatist idea. Also, creating a WhatsApp group or editing a harmless toolkit is not a crime.

The judge, in his bail order, said that citizens ‘are conscience keepers of government in any democratic nation’ adding that they ‘cannot be put behind the bars simply because they choose to disagree with the State policies.’ “The offence of sedition cannot be invoked to minister to the wounded vanity of the governments.” the judge said.

He added, “Difference of opinion, disagreement, divergence, dissent, or for that matter, even disapprobation, are recognised legitimate tools to infuse objectivity in state policies.”

Delhi Police’s allegations against Disha Ravi

The court was told on behalf of Delhi Police that Disha had prepared a toolkit, which was done on the direction of the advocates of Khalistan. All this has been done to tarnish the image of India. Khalistan supporters want to strengthen their flag by bringing this movement in their favor. It was not just a tool kit, but a draft to discredit India.

The police had also told the court that Disha Ravi knew that if she got caught in a legal confusion, her WhatsApp chat and e-mail could become a sore throat, so she deleted all the chats and mails. If Disha did nothing wrong then why did she destroy the evidence to clear her way? This is enough to convict her. Disha Ravi is a major part of the group involved in India’s infamy.

A ‘toolkit’ is a document in which detailed information is provided to inform an issue and take steps related to it. Usually, during a major campaign or movement, people participating in it are given directions in it. Its purpose is to give guidelines for activities at the grassroots level to a particular class or target group. The trial court on Friday sent the climate worker to judicial custody for three days after Disha’s five-day police custody period ended. Disha was arrested by the Cyber ​​Cell of Delhi Police from Bengaluru on 13 February. A case has been registered against Disha on sedition and other charges.
